Acceptable Use Policy

This Acceptable Use Policy ("AUP") outlines unacceptable uses of the EchoTexting platform and related services (“Services”). By using our Services, you agree to follow this AUP, and ensure that your employees, contractors, customers, or any party you authorize to access your account do the same.
EchoTexting may update this AUP at any time, with or without notice. Continued use of the Services after any changes constitutes acceptance of the modified policy.
1. Prohibited Content and Uses
You may not use EchoTexting Services to send, distribute, or promote any content that:
- Violates any law, regulation, court order, or other legal obligation.
- Infringes on the intellectual property, privacy, or publicity rights of others.
- Is defamatory, harassing, abusive, libelous, or threatening.
- Is obscene, sexually explicit, pornographic, or depicts graphic violence.
- Promotes discrimination, hate speech, or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected category.
- Promotes, sells, or facilitates illegal products, services, or conduct.
- Is fraudulent, deceptive, or intended to mislead others (including phishing, impersonation, or fake offers).
- Promotes gambling or betting services unless compliant with all applicable laws and regulations.
- Promotes content or industries prohibited by The Campaign Registry.
- Links to malware, spyware, viruses, or malicious software of any kind.
This list is illustrative and not exhaustive. EchoTexting reserves the right to determine, in its sole and reasonable discretion, whether content or use violates this AUP.
2. Consent and Messaging Compliance
All users must:
- Obtain clear, written, and verifiable consent from message recipients before sending any SMS, MMS, or other communications.
- Follow all applicable laws and regulations including, but not limited to, the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and CTIA guidelines.
- Include clear sender identification in all messages.
- Provide recipients with opt-out instructions such as “Reply STOP to unsubscribe”.
- Respect and act on all opt-out requests promptly.
- Maintain clear records of opt-in and opt-out data.
3. Prohibited Campaigns and Tactics
You may not:
- Use scraped or purchased contact lists.
- Engage in message bombing, spoofing, or intentionally misleading routing practices.
- Impersonate any person or entity or misrepresent your identity or affiliation.
- Use URL shorteners or redirectors deceptively or in a way that conceals destination content.
- Use message frequency or volume in a way that disrupts or degrades service performance.
- Conduct emergency, political, or broadcast-style alerts without appropriate authorization.
You may use your own link shortener, but EchoTexting provides an official short link service at https://txtm.in, which we recommend using for compliance and deliverability purposes.
4. System Abuse
You may not:
- Attempt to gain unauthorized access to any systems, accounts, or data.
- Interfere with or disrupt our networks or systems, or those of our partners.
- Send high volumes of automated messages without ensuring fair use.
- Circumvent, probe, or test system or network security mechanisms.
- Introduce malware, bots, or unauthorized automation into the platform.
5. Third-Party Integrations
EchoTexting may, now or in the future, support third-party integrations. Users must not:
- Use integrations to bypass restrictions or limitations within our Services.
- Sync or transmit data that violates this AUP or applicable regulations.
- Misuse APIs or automation tools in a way that circumvents fair and reasonable use.
All integrations must comply with this AUP and applicable law.
6. Enforcement and Reporting
EchoTexting reserves the right to:
- Investigate violations of this AUP at its sole discretion.
- Suspend or terminate accounts without notice for violations.
- Block messages or take any necessary action to enforce this policy.
- Monitor content to investigate abuse, but we do not and cannot monitor all use of the Services.
We may cooperate with and respond to lawful requests or inquiries from law enforcement, regulators, or industry partners, including but not limited to the FCC, FTC, and the USTelecom Industry Traceback Group.

7. Legal and Indemnification
If you violate this AUP, we may stop providing Services to you and/or close your account. You agree to defend, indemnify, and hold harmless EchoTexting, its affiliates, and personnel from any claims, liabilities, or expenses (including attorney’s fees) resulting from your violation of this AUP or your misuse of the Services.
8. Final Notes
This list of prohibited uses is meant to be illustrative and should not be considered exhaustive. All determinations related to violations of this AUP will be made by EchoTexting in its sole, reasonable discretion.
EchoTexting reserves the right to change or modify the terms of this AUP at any time. Your continued use of our Services after any such change constitutes your acceptance of the new terms.
