Welcome to Echo Texting, LLC (“Echo Texting”, “we”, “our”, or “us”). These Terms of Use (“Terms”) govern your access to and use of our website at https://echotexting.com (the “Site”), and our SMS, MMS, AI-based, and two-way messaging platform and related services (the “Services”). By using our Site or Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Services.

1. Eligibility & Access

You must be at least 18 years old to use our Services. By registering or using Echo Texting, you represent and warrant that:

  • You are at least 18 years of age;
  • You possess the legal authority to enter into these Terms;
  • Your use of the Services complies with all applicable local, state, and federal laws.

2. Service Overview

Echo Texting provides a messaging platform for businesses and organizations to engage subscribers via:

  • SMS (Short Message Service)
  • MMS (Multimedia Messaging Service)
  • Two-way text communication
  • AI-based response automation

While we currently do not offer third-party integrations, the Terms allow for their future inclusion without revision.

3. Account Creation

To access and use our Services, you must create an account. Echo Texting uses magic link authentication only. You are solely responsible for:

  • Providing accurate account information;
  • Maintaining the security of your login credentials;
  • All activity under your account.

You must immediately notify Echo Texting of any unauthorized access to your account.

4. Fees & Billing

Echo Texting charges:

  • A monthly compliance fee for each active account;
  • Prepaid credits used to send messages through our platform.

All payments are final and non-refundable. Unused credits do not expire while your account remains active. Prices are subject to change with prior notice.

If your account is suspended or terminated for violation of these Terms, you forfeit all prepaid balances and access to our platform.

5. Messaging Compliance

You agree to comply with all applicable laws, including but not limited to:

  • The Telephone Consumer Protection Act (TCPA);
  • The CAN-SPAM Act;
  • CTIA guidelines and best practices.

Opt-in Required:
You must obtain express written consent from all subscribers before sending them any messages.

Opt-out Requirements:
Every message must include clear opt-out instructions (e.g., “Reply STOP to unsubscribe”). If a subscriber opts out, you must immediately cease communication with them unless they opt back in.

Echo Texting provides built-in compliance tools but is not responsible for your specific use of the platform or your legal obligations.

6. Acceptable Use Policy

You may not use the Services to:

  • Send unsolicited messages (spam);
  • Engage in phishing, fraud, or illegal solicitation;
  • Send content that is abusive, defamatory, hateful, or obscene;
  • Promote controlled substances, sex-related products, gambling, or weapons;
  • Transmit harmful code or disrupt system functionality;
  • Bypass account limits or system integrity mechanisms.

Echo Texting reserves the right to monitor usage, investigate violations, and suspend or terminate accounts at its sole discretion.

7. Security

Echo Texting uses magic link authentication to reduce the risk of password-related breaches. You agree not to circumvent security features or allow unauthorized access to your account.

While we use reasonable measures to safeguard data, no system is 100% secure. You use the Services at your own risk.

8. Privacy Policy

Echo Texting is committed to protecting your privacy. For details on how we collect, use, and protect your data, please see our Privacy Policy (link will be provided once published).

You are responsible for ensuring your use of subscriber data complies with applicable privacy laws, including but not limited to TCPA, CAN-SPAM, and any industry-specific regulations.

9. Termination

Echo Texting may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms or applicable law.

You may cancel your account at any time by contacting [email protected].

Upon termination, you lose access to your account, all prepaid credits, and stored data. We are not liable for any losses associated with termination.

10. Intellectual Property

All materials on our Site and within the Services—including trademarks, code, design, and content—are the intellectual property of Echo Texting or its licensors. You may not reproduce, modify, or distribute our content without prior written consent.

11. Third-Party Services

Echo Texting may introduce optional third-party integrations in the future. If you choose to use them, your use will be governed by the respective third-party terms and privacy policies. Echo Texting is not responsible for third-party products or services.

12. Modifications

We may update these Terms at any time. When we do, we’ll revise the “Last updated” date at the top of the page and provide notice on our website or via email. Continued use of the Services after changes means you accept the revised Terms.

13. Disclaimer of Warranties

The Services are provided “as is” and “as available.” Echo Texting disclaims all warranties, express or implied, including but not limited to:

  • Merchantability;
  • Fitness for a particular purpose;
  • Non-infringement;
  • System availability, reliability, or performance.

We do not guarantee message delivery or subscriber behavior.

14. Limitation of Liability

To the fullest extent permitted by law, Echo Texting shall not be liable for:

  • Indirect, incidental, or consequential damages;
  • Lost profits or business opportunities;
  • Damages from data loss or system interruptions.

Our total liability for any claim will not exceed the amount you paid to Echo Texting in the prior 6 months.

15. Indemnification

You agree to indemnify and hold harmless Echo Texting, its officers, employees, agents, and affiliates from any claims, damages, or legal fees arising from your:

  • Violation of these Terms;
  • Breach of any law or regulation;
  • Misuse of the Services;
  • Infringement of intellectual property rights.

16. Dispute Resolution & Arbitration

Binding Arbitration:
You agree to resolve any disputes with Echo Texting through final and binding arbitration, rather than in court, under the rules of the American Arbitration Association.

Class Action Waiver:
You agree to bring any claim against Echo Texting individually and not as part of a class or representative action.

Small Claims Exception:
Either party may bring claims in small claims court in Laramie County, Wyoming if the claims qualify.

17. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. All claims shall be resolved in the appropriate courts of Laramie County, Wyoming, unless subject to arbitration.
